When is mediation good for plaintiffs?

On Behalf of | Jun 27, 2023 | Mediation & Arbitration

Mediation can be a great way to avoid the lengthy process of litigation in the courtroom. It is an alternative way to resolve a dispute that can benefit both parties in a case.

When you file a lawsuit, it is helpful to see how mediation can be to your advantage.

Give your full story

Mediation allows you the time to fully explain the situation. You can lay out the details more easily and give all the facts that outline why the other party is in the wrong. In court, you have limited time to tell your side, which can be detrimental.

Go beyond the law

In the courtroom, the judge only cares about the legal matters at hand. Sometimes, outside factors also play into a case. During mediation, you can go beyond the law and bring up those other factors that could influence the outcome of the case. It is possible to reach an agreement simply because there is something outside the law going on. In court, if you cannot make a strong legal case, you could lose.

Reach different agreements

The court has to follow the options under the law for resolving your dispute. In mediation, you do not have such restrictions. You can get creative and think outside the box. You may be able to reach an agreement that is something that works well for both parties that a judge could never have given you.

Mediation still allows you to work through the legal issue at hand, but it gives you much more freedom. This is beneficial to you as much as it is to the other party.
